EULA - End User License Agreement

IMPORTANT-READ CAREFULLY: This End-User License Agreement (EULA) is a legal agreement between you (individual or single entity) and Djikic Software Development Team (Djikic) for the WhizBase ("the software"). By installing and using the software you signify your acceptance of this EULA and you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the software.

1. THE LICENSE: The software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The software is licensed, not sold.

GRANT OF LICENSE. This EULA grants you the following rights:

SINGLE DOMAIN LICENSE: Once registered, you may use the software on one Internet domain (e.g., site.com), for any legal purpose. You can use it on any number of databases as long as the WhizBase documents (*.wbsp) are hosted on a domain for which you purchased the license.
SERVER LICENSE: Once registered, you may use the software on one server machine regardless of number of processors it has and domains it hosts. WhizBase Server license is valid for all the domains hosted on the server for which you purchased the license. Server license does not limit the number of virtual hosts that may use the software on a single server computer.
DEVELOPER LICENSE: Once registered, you may use the software on any server computer for any web site you develop. Developer license is valid for any web content (web presentation, application, etc. on any virtual host or domain) developed by developer for whom the license is purchased.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS: Limitations on Using, Reverse Engineering, Decompilation, and Disassembly. You may not use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the licensed program, or any subset of the licensed program, except as provided for in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.
Djikic reserves all rights not expressly granted here.
Termination: Without prejudice to any other rights, Djikic may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the software and all of their component parts.

3. COPYRIGHT: All Copyrights in and to the software and any copies of the software are owned by Djikic. The software is protected by copyright laws and international treaty provisions. Therefore, you must treat the software like any other copyrighted material.

4. MISCELLANEOUS: The Shareware (trial) version of the software may be freely distributed, provided the distribution package is not modified. No person or company may charge a fee for the distribution of the software without written permission from the copyright holder.

5. LIMITED WARRANTY

NO WARRANTIES. Djikic expressly disclaims any warranty for the software. The software and any related documentation are provided "as is" without warranty of any kind, either express or implied. The entire risk arising out of use or performance of the software remains with you.
NO LIABILITY FOR DAMAGES. In no event shall Djikic be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the software, even if Djikic has been advised of the possibility of such damages.
